Third wave of asbestos victims
The first wave mined asbestos and the second wave – generally tradespeople – worked with manufactured asbestos. The third wave brought it into their homes, mostly do-it-yourself home renovators exposed while fixing up the family home.
The numbers of third-wave victims are not declining. In fact, lawyers specialising in asbestos cases warn the peak is yet to come, and that homeowners are still being put at risk.
Unlike the first and second waves, third-wave victims may have also exposed their children. Herman’s daughter Heidi remembers playing in asbestos dust when her father was building the back room, using off cuts like chalk to draw on the ground in the backyard.

RECENT CASE STUDY 2017 – Dust Disease Claims Sydney
ASBESTOS LITIGATION – A NEW HEAD OF DAMAGE?
On 26 May 2017 Judge Gilchrist of the District Court of South Australia delivered his decision in the matter of Latz v Amaca Pty Ltd (formerly James Hardie & Co Pty Ltd). It included an award of compensation for lost pension payments in the “lost years”, a first.
The claimant Mr Latz was a retired surveyor that had terminal malignant mesothelioma. He alleged that this resulted from exposure to asbestos that was produced by James Hardie & Coy Pty Ltd during the course of building, construction and renovation work carried out at a house residence that he had constructed in Glenalta, South Australia between 1976 and 1977.
The Court accepted that Mr Latz erected a fence on the Glenalta property in that time period that was comprised of asbestos sheets that were manufactured and sold by James Hardie & Coy Pty Ltd, which caused the exposure to asbestos dust (dust disease claims). The Court concluded that he was entitled to judgment for damages.

Silicosis & Dust Disease Claims
Traditionally associated with the mining industry, silicosis causes scarring of the lungs leading to progressive respiratory impairment. Some sufferers eventually require a lung transplant and it may lead to death.
Across the globe, annual deaths from silicosis are dropping. However, Australian medical and legal experts are alarmed to note a recent spike in new cases of life-threatening silicosis. This spike has been attributed to occupational exposure (often by tradies) to so-called engineered or artificial stone products often used for kitchen bench tops.
